1. Acceptance of Terms & Legal Eligibility

This Terms and Conditions & End-User License Agreement ("Agreement", "Terms") constitutes a legally binding contract between you ("User", "Player", "you", or "your") and ShadowHunt ("Platform", "Application", "we", "us", or "our"), based and operated out of Pune, Maharashtra, India.

This document is an electronic record generated by a computer system in accordance with the Information Technology Act, 2000, the Indian Contract Act, 1872, and the applicable rules thereunder. This electronic record does not require physical or digital signatures.

1. Capacity to contract: you warrant that you are at least 18 years of age, possess the legal capacity to enter into a binding contract under the Indian Contract Act, 1872, and are not barred by law from using this Service. If you are under 18, you are strictly prohibited from using the Application without verified parental or legal guardian supervision.
2. Acceptance: by downloading, installing, launching, registering, or playing ShadowHunt, you agree to be bound by all provisions of this Agreement and our Privacy Policy. If you do not accept these terms unconditionally, you must immediately uninstall and cease all use of ShadowHunt.

2. Real-World Gameplay & Voluntary Assumption of Risk

ShadowHunt utilizes real-time GPS, compass, Bluetooth Low Energy (BLE), and sensor data to conduct real-world manhunt, pursuit, evasion, and social deduction game loops in physical spaces.

2.1 Full assumption of risk. You expressly acknowledge, understand, and agree that:

• Playing ShadowHunt requires physical exertion, movement, and navigation across outdoor, urban, suburban, or public environments.
• Real-world hazards exist including, but not limited to: moving vehicular traffic, trains, bicycles, uneven terrain, cliffs, bodies of water, potholes, construction sites, slippery surfaces, animal encounters, weather extremes, poor lighting, and unpredictable conduct of third parties or crowds.
• Distraction hazard: looking at a mobile phone screen while walking, jogging, or running poses inherent safety risks. You agree to prioritize your physical surroundings, peripheral vision, and personal safety over game performance at all times.
• Voluntary participation: you participate in ShadowHunt voluntarily, at your own discretion, and at your own sole risk.

2.2 Medical & physical fitness. You acknowledge that you are in adequate physical condition to engage in real-world walking or running games. If you have underlying medical conditions, cardiovascular issues, respiratory issues, or injuries, consult a physician before engaging in game activities.

3. Strict Code of Conduct & Compliance with Indian Law

While using ShadowHunt, you unconditionally agree to strictly comply with all local, state, and national laws of the Republic of India, including the Bharatiya Nyaya Sanhita (BNS) / Indian Penal Code (IPC), the Motor Vehicles Act, 1988, the Information Technology Act, 2000, and all local municipal regulations.

3.1 Prohibited real-world activities. You shall NOT:

1. Trespass: enter, traverse, or linger upon private property, gated communities, residential premises, construction zones, corporate offices, railway tracks, airports, military/defense establishments, or any restricted or dangerous area without lawful written permission.
2. Motor vehicle operation: use, monitor, glance at, or interact with ShadowHunt while operating a motorized vehicle, motorcycle, scooter, bicycle, skateboard, or other conveyance.
3. Physical confrontation & assault: physically grab, tackle, push, strike, threaten, intimidate, or assault any player, spectator, or bystander. In-game tagging occurs electronically through proximity sensors, BLE, or NFC — physical contact is unnecessary and forbidden.
4. Harassment & stalking: follow, harass, stalk, film without consent, or intimidate any person in a manner that creates fear, distress, or constitutes an offense under Indian criminal law.
5. Nuisance & public order: create public disturbances, block traffic, obstruct pedestrian flow, incite panic, or engage in riotous conduct.
6. Disregard of public safety: ignore traffic signals, cross roads unsafely, or violate civic bylaws.

3.2 Prohibited digital & technical actions. You shall NOT:

1. Spoof, manipulate, or fake GPS coordinates, compass headings, or Bluetooth signals;
2. Reverse engineer, decompile, disassemble, or extract source code from the Application;
3. Use automated bots, scrapers, exploits, or third-party unauthorized software to gain competitive advantage;
4. Interfere with, overload, or disrupt the backend infrastructure, databases, or network connections;
5. Upload, transmit, or set profile names containing defamatory, obscene, pornographic, hateful, racially offensive, or illegal content under Section 67 of the IT Act, 2000 or the IT Rules, 2021.

We reserve the absolute right to suspend, terminate, or permanently ban any user account found violating these provisions without prior notice or refund.

4. Complete Exclusion of Liability & "As Is" Disclaimer

4.1 Disclaimer of warranties. ShadowHunt is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, statutory, or implied. To the maximum extent permitted under applicable Indian law, we disclaim all warranties, including merchantability, fitness for a particular purpose, title, accuracy of GPS or map data, continuous uninterrupted availability, or freedom from bugs, viruses, or network outages.

4.2 Comprehensive limitation of liability. To the maximum extent permitted by the laws of India, neither ShadowHunt, nor its founders, operators, developers, directors, employees, agents, contractors, or partners shall be held liable for any injury, damage, loss, or harm whatsoever arising out of or in connection with your use of, or inability to use, the Application. This exclusion applies to:

1. Personal injury or wrongful death — slips, trips, falls, road accidents, vehicular collisions, bicycle accidents, cardiac events, physical assault, animal bites, or any other physical or psychological harm or loss of life incurred during or related to gameplay;
2. Property loss or damage — damage to, cracking of, theft, water damage, or loss of smartphones, wearables, vehicles, or personal belongings;
3. Legal fines or prosecution — criminal charges, arrests, civil lawsuits, or municipal fines levied against you for trespassing, traffic violations, public nuisance, or breach of local regulations;
4. Conduct of third parties — actions, omissions, violent behavior, or negligence of other players, teammates, opponents, strangers, or property owners;
5. Indirect & consequential damages — special, incidental, punitive, exemplary, or consequential damages, including loss of profits, data loss, or business interruption.

Your sole and exclusive remedy for dissatisfaction with the Application is to cease using and uninstall ShadowHunt.

5. Indemnification

You agree to defend, indemnify, and hold harmless ShadowHunt, its developers, operators, administrators, affiliates, and representatives from and against any and all claims, demands, liabilities, damages, judgments, awards, losses, costs, expenses, or legal fees (including attorney's fees) arising out of or resulting from:

1. Your violation or breach of this Agreement;
2. Your conduct during real-world gameplay, including your presence on any property or interaction with any person;
3. Your violation of any third-party rights, including privacy rights, intellectual property, or property ownership;
4. Your violation of any statute, ordinance, or regulation of India (including traffic, trespass, and criminal statutes);
5. Any reckless, grossly negligent, or intentional misconduct by you.

This defense and indemnity obligation survives the termination of your account or cessation of your use of ShadowHunt.

6. Intellectual Property Rights

All right, title, and interest in and to ShadowHunt — including the source code, user interfaces, visual design, sound effects, animations, game design logic, trademarks, logos, and digital assets — are and remain the exclusive intellectual property of the operators of ShadowHunt. You are granted a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to download and play the App on your personal mobile device strictly for personal, non-commercial entertainment purposes.

7. Third-Party Services & Telecommunication Data

1. Third-party providers: ShadowHunt utilizes third-party tools and services (such as Supabase, Google Play Services, Google Sign-In, and map tile services). We are not responsible for the availability, uptime, content, or practices of third-party platforms.
2. Data charges: gameplay necessitates live mobile data transmission. You are solely responsible for all carrier data fees, SMS charges, and device battery consumption incurred while using the App.

8. Account Termination & Discontinuation

We reserve the right, in our sole discretion, without penalty or liability:

1. To modify, pause, restrict, or discontinue any feature, map zone, game mode, or the entire Application at any time without prior notice;
2. To suspend, revoke, or terminate your access, ban your IP or device UUID, or delete your account immediately if we suspect fraudulent activity, cheating, hazardous behavior, abusive communication, or any breach of these Terms.

9. Governing Law & Exclusive Jurisdiction

This Agreement, its interpretation, and any dispute, controversy, or claim arising out of or related to this Agreement or the use of ShadowHunt shall be governed by, construed, and enforced exclusively in accordance with the substantive laws of the Republic of India, without regard to conflict of law principles.

Exclusive court jurisdiction in Pune. The parties irrevocably agree that all disputes, claims, suits, or legal proceedings arising out of or relating to this Agreement or the Platform shall be subject to the exclusive jurisdiction of the competent courts of law located in Pune, Maharashtra, India. You expressly waive any defense of lack of personal jurisdiction, inconvenient forum, or venue objection to the courts located in Pune.

Pursuant to the Information Technology Act, 2000 and the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021:
